Politically Exposed Person
In accordance with the Law on the Prevention of Money Laundering and Terrorism and Proliferation Financing, a politically exposed person is a person who holds or has held a prominent public office in the Republic of Latvia, another Member State, or a third country, including a senior public official, head of an administrative territorial unit (municipality), head of government, minister (deputy minister or deputy to a deputy minister, if such a position exists under the laws of the relevant country), state secretary or other senior official in government or a public administration unit (municipality), member of parliament or a member of a similar legislative body, member of the governing body (board) of a political party, judge of a constitutional court, supreme court or other level court, member of the governing body of a supreme audit institution, member of the council or board of a central bank, ambassador, chargé d’affaires, senior officer of the armed forces, member of the council or board of a state-owned enterprise, head (director, deputy director) or member of the board of an international organisation, or a person holding an equivalent position in such an organisation.
A family member of a politically exposed person is a person who is:
- a) a spouse or a person equivalent to a spouse (such status is recognised only if it is provided for by the laws of the relevant country);
- b) a child of the politically exposed person or of the spouse or person equivalent to a spouse, as well as their spouse or person equivalent to a spouse;
- c) a parent, grandparent, or grandchild;
- d) a brother or sister.
A person closely associated with a politically exposed person is a natural person who is known to have business or other close relationships with a politically exposed person, or who is a shareholder or participant in the same commercial company together with a politically exposed person, as well as a natural person who is the sole owner of a legal entity that is known to have been established for the benefit of a politically exposed person.
